Article 24 of the United Nations Convention on the Rights of Persons with Disabilities (2006) makes it clear that children with disabilities shall not be discriminated against and have a right to participate in the general education system. The Department of Education, in January 2020, found that 12.1% of all students in the UK have special educational needs but only 3.3% of pupils had an education, health and care (ECH) plan in place.
