Japan — Taxes on Alcoholic Beverages WT/DS8

Critically discuss the Japan Alcoholic Beverages case and its jurisprudential implications, making reference to DSC products SATAP (GATT Art III:2, second sentence).

Section B – Answer one question from this section (75%):

1. “The institutional framework crafted so carefully at Bretton Woods and Havana began to break down almost immediately as the world emerged from the shadows of war. While the institutions remain, they are fundamentally different today from what was envisaged in the mid-1940s. This is not so surprising, however. The international economy too has changed beyond all recognition.”

Discuss, with reference both to the Bretton Woods institutions and the GATT/WTO.

2. What is the role and function of dispute settlement under the WTO? By reference to its institutions, procedures and jurisprudence, comment on the effectiveness and weakness of WTO dispute settlement in achieving its intended objectives.

3. “There is no real system of international economic law, just a patchwork of bilateral and multilateral instruments and institutions.”

Discuss with reference to the non-WTO components of international economic law.
